Dispute Resolution

If something goes wrong between you and RewriteAIForMe, this page describes how it will be worked out. We prefer to resolve disputes through honest conversation; this page covers what happens if that does not succeed.

Informal resolution first

Before commencing any formal proceeding, you agree to contact us through the contact page and attempt in good faith to resolve the dispute informally for a period of at least sixty days from the date of that notice. Most disputes resolve at this stage.

Governing law

These terms and any dispute arising from or relating to them or to your use of the service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws of your place of residence apply.

Binding arbitration

To the fullest extent permitted by applicable law, any dispute that is not resolved informally will be resolved by final and binding arbitration administered by a recognised arbitration provider under its then-current commercial rules. Arbitration will be conducted in the English language. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver

To the fullest extent permitted by applicable law, you and the Protected Parties agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of multiple parties.

Carve-outs

Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual-property rights pending arbitration. Nothing in this page waives any non-waivable right under applicable law.

Severability

If any portion of this page is found unenforceable, the remainder will continue in full force and effect; the unenforceable portion will be modified to the minimum extent necessary to be enforceable.
